Terms of Service

1. Acceptance of Terms

By accessing or using SnapSell ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use our platform. These Terms constitute a legally binding agreement between you and SnapSell. Your continued use of the platform after any changes to these Terms constitutes acceptance of the updated Terms.

2. SnapSell as Marketplace Intermediary

SnapSell operates as a marketplace platform that connects independent buyers and sellers. SnapSell is not a party to any transaction between buyers and sellers. When you buy or sell an item through SnapSell, you are entering into a contract directly with the other party — not with SnapSell.

SnapSell facilitates transactions by providing listing tools, AI-assisted listing generation, escrow payment processing, and dispute mediation services. SnapSell does not buy, sell, or take ownership of any items listed on the platform. Sellers are independent parties responsible for their listings and fulfillment; buyers are independent parties responsible for their purchases and payments.

3. Seller Obligations

By listing items on SnapSell, you agree to:

  • Provide accurate, honest, and complete item descriptions, including any defects, damage, or limitations
  • Ship sold items within 3 business days of receiving sale confirmation
  • Respond to buyer inquiries promptly, and no later than 2 business days after receipt
  • Ensure items shipped match the listing description; material discrepancies may result in refunds at your expense
  • Only list items you own and have the legal right to sell
  • Comply with all applicable laws regarding the sale of items in your jurisdiction

Failure to meet these obligations may result in order cancellation, negative seller ratings, escrow refunds to buyers, or account suspension.

4. Buyer Obligations

By purchasing items on SnapSell, you agree to:

  • Pay promptly and in full upon completing a purchase
  • Provide accurate shipping information to enable delivery
  • File disputes honestly and only for legitimate "item not as described" cases — not as a mechanism to avoid paying or to obtain refunds for items that match their description
  • Respond to SnapSell dispute mediators promptly when contacted

Abuse of the dispute system — including false claims or repeat frivolous filings — may result in account suspension or permanent ban from the platform.

5. Escrow Payment System

SnapSell uses an escrow system to protect both buyers and sellers:

  • All buyer funds are collected and held in escrow by SnapSell at the time of purchase
  • Funds are released automatically to the seller 3 days after confirmed delivery, unless a dispute is filed within that window
  • Buyers must file an "item not as described" dispute within the 3-day window after confirmed delivery to trigger escrow review
  • Once funds are released from escrow, SnapSell cannot reverse the payment; any further resolution must occur directly between buyer and seller

The escrow window begins upon confirmed delivery (tracking confirmation) or, if tracking is unavailable, upon the seller's self-reported ship date plus a reasonable delivery estimate.

6. Dispute Process

SnapSell offers dispute mediation exclusively within the escrow window:

  • Buyers have 3 days from confirmed delivery to file a dispute
  • To file a dispute, buyers must describe the discrepancy between the listing and the received item, and provide supporting photos where applicable
  • SnapSell will review the dispute and may contact both parties for additional information; decisions are made within 5 business days of filing
  • SnapSell's dispute decisions are final for purposes of escrow disbursement
  • After escrow funds have been released to the seller, SnapSell is no longer a party to any dispute; buyer and seller must resolve directly

SnapSell is not liable for outcomes of disputes that arise after the escrow window has closed and funds have been disbursed.

7. Returns Policy

SnapSell does not operate a centralized returns program. Returns are governed by each individual seller's return policy as stated in their listings.

  • Sellers are encouraged to clearly state their return policy in each listing (e.g., "No returns," "Returns accepted within 14 days")
  • SnapSell does not process returns or issue refunds outside of the escrow dispute window described in Section 6
  • If a buyer wishes to return an item after the escrow window has closed, they must contact the seller directly and negotiate a resolution

8. Commissions & Fees

SnapSell charges the following commission rates on completed sales:

  • Standard sellers: 15% commission on each completed sale
  • Gold Sellers: 10% commission + $9.99/month Gold Membership fee (see Section 9)
  • First-sale promotional rate: 7.5%on a seller's first completed sale on the platform
  • Standard sellers — vehicles: 5% commission on each completed vehicle sale
  • Gold Sellers — vehicles: 3.5% commission on each completed vehicle sale
  • First-sale promotional rate — vehicles: 2.5% on a seller's first completed vehicle sale
  • No listing fees — you pay only when an item sells

Commissions are deducted from the sale proceeds before disbursement to the seller. SnapSell reserves the right to modify commission rates with 30 days' notice to affected sellers.

9. Gold Membership Terms

The Gold Seller membership provides a reduced commission rate for active subscribers:

  • Monthly billing at $9.99/month, charged on the same day each month
  • Commission rate reduction from 15% to 10% is effective immediately upon successful subscription activation
  • You may cancel your Gold Membership at any time; cancellation takes effect at the end of your current billing period
  • Upon cancellation, your commission rate returns to 15% at the start of the next billing cycle
  • No partial refunds are issued for unused portions of a billing period
  • SnapSell reserves the right to modify the Gold Membership price with 30 days' advance notice to current members

9b. Pro Business & Enterprise Subscriptions

Pro Business accounts (Starter, Growth, Scale) and Enterprise accounts are billed on a recurring monthly basis through Stripe. By signing up for any Pro Business tier, you agree to the following:

  • 9b.1 Pilot period. The first 30 days of your Pro Business subscription are free. You may cancel any time before day 30 to avoid any charge. After the pilot ends, your selected tier begins billing monthly ($99, $199, or $299).
  • 9b.2 Early Termination Fee (ETF). If you cancel a Pro Business subscription within the first 6 months of paid service, an ETF of 50% of remaining contract value is charged. After month 6, you may cancel at any time without an ETF. The ETF is charged once on cancellation and is non-refundable.
  • 9b.3 Commission. The Pro Business commission rate (8%, 7%, or 6% per sale depending on tier) is effective immediately upon successful subscription activation and replaces the standard 15% rate (or 10% Gold Seller rate, if applicable) for as long as your subscription remains active.
  • 9b.4 Listing caps. Starter caps Pro Business listings at 100/month, Growth at 500/month, and Scale has no cap. The cap applies to net new listings created in a calendar month; delisted or sold listings do not refill it within the same month.
  • 9b.5 Acknowledgment at signup.By checking the "Terms" and "ETF acknowledgment" boxes at signup, you confirm that you have read this section (and the rest of the Terms), understand the ETF schedule, and agree to be bound by it.
  • 9b.6 Enterprise accounts. Enterprise pricing, commission, listing caps, and contract terms are negotiated individually between the account holder and SnapSell. The ETF schedule above does not apply to Enterprise contracts — see your signed Enterprise agreement for the early termination terms that govern your account.

SnapSell reserves the right to modify Pro Business pricing, commission rates, or the ETF schedule with 30 days' advance notice to active subscribers. Continued subscription after such notice constitutes acceptance of the change.

10. Prohibited Items

The following are prohibited on SnapSell:

  • Counterfeit, replica, or unauthorized brand goods
  • Stolen property or items obtained through fraud
  • Hazardous, flammable, or toxic materials
  • Live animals or endangered species products
  • Firearms, ammunition, and regulated weapons
  • Controlled substances, drugs, or drug paraphernalia
  • Any items whose sale is illegal under applicable US federal or state law, or the laws of the seller's or buyer's jurisdiction

11. Account Termination

By SnapSell: SnapSell may suspend or permanently terminate any account that violates these Terms, engages in fraudulent activity, abuses the dispute system, or poses a risk to other users or the platform. We will attempt to provide reasonable notice except where immediate action is required to protect users or the platform.

By you: You may close your account at any time via your account Settings page. Account closure is effective within 5 business days of request.

Upon account closure — whether by you or by SnapSell — any funds held in open escrow will be disbursed according to the applicable dispute resolution outcomes. Outstanding commissions owed remain due. Active listings will be removed.

12. Limitation of Liability

To the fullest extent permitted by applicable law:

  • SnapSell is not liable for disputes between buyers and sellers after escrow funds have been released; such disputes are solely between the buyer and seller
  • SnapSell's total aggregate liability to any user shall not exceed the total commissions paid by that user to SnapSell in the 12 months preceding the claim
  • SnapSell is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption, even if advised of the possibility of such damages
  • SnapSell is not responsible for the actions or omissions of buyers or sellers, including failure to ship, failure to pay, or misrepresentation of items

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain liabilities; in such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Governing Law

These Terms of Service and any disputes arising from or relating to them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Delaware for any such disputes.

14. Changes to Terms

We may update these Terms from time to time. Continued use of SnapSell after changes constitutes acceptance of the new Terms. We will notify users of material changes via email at least 30 days in advance. The date of the most recent update is shown at the top of this page.
